1 Acceptance of Terms

By accessing or using TotalApp ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you are using TotalApp on behalf of an organisation, you represent that you have authority to bind that organisation to these terms.

If you do not agree to these terms, please do not use the Service.

2 Description of Service

TotalApp is a cloud-based business management platform providing tools for project management, human resources, finance, sales, marketing automation, and related business functions. The Service is provided on a subscription basis with free and paid tiers.

We reserve the right to modify, suspend or discontinue any part of the Service with reasonable notice.

3 Accounts & Registration

To use TotalApp you must create an account. You agree to:

• Provide accurate and complete registration information
• Keep your password confidential and not share it with others
• Notify us immediately of any unauthorised access to your account
• Be responsible for all activity that occurs under your account

You must be at least 16 years old to create an account. Accounts registered by bots or automated methods are not permitted.

4 Acceptable Use

You agree not to use TotalApp to:

• Violate any applicable law or regulation
• Infringe the intellectual property rights of others
• Transmit spam, malware, or other harmful content
• Attempt to gain unauthorised access to our systems or other users' accounts
• Reverse engineer, decompile or disassemble any part of the Service
• Use the Service to build a competing product
• Overburden our infrastructure in ways that degrade service for others
• Store or transmit unlawful, harassing, defamatory or obscene content

We reserve the right to suspend accounts that violate these terms.

5 Your Data

You own your data. The content you upload, create or store in TotalApp belongs to you. You grant us a limited licence to host, process and display your content solely to provide the Service.

You are responsible for ensuring that your data does not violate any third-party rights or applicable laws. We do not review user content except when required for security investigations or legal compliance.

Upon account termination, you may export your data. We will delete your data within 30 days of termination, except where retention is required by law.

6 Intellectual Property

TotalApp and its original content, features and functionality are owned by TotalApp and are protected by international copyright, trademark and other intellectual property laws.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

You retain all rights to content you create using TotalApp's tools. AI-generated content produced through our platform is owned by you, subject to the terms of the underlying AI providers.

7 Payment & Billing

Paid plans are billed in advance on a monthly or annual basis. By providing payment information, you authorise us to charge your payment method for all fees incurred.

• Upgrades: Take effect immediately; you are charged a prorated amount for the remainder of the billing period.
• Downgrades: Take effect at the end of the current billing period.
• Refunds: We offer a 14-day money-back guarantee on annual plans. Monthly plans are non-refundable.
• Price changes: We will notify you at least 30 days before any price change.

All fees are exclusive of taxes. You are responsible for any taxes applicable in your jurisdiction.

8 Termination

You may terminate your account at any time from your account settings. Termination takes effect at the end of your current billing period.

We may suspend or terminate your account immediately if you violate these Terms. We will provide notice where reasonably possible. Upon termination, your right to use the Service ceases immediately.

9 Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

We are not responsible for any third-party integrations, services or content accessed through TotalApp. AI-generated content may be inaccurate — always review before relying on it for business decisions.

10 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOTALAPP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Turkey, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Istanbul, Turkey, unless otherwise required by applicable consumer protection laws in your jurisdiction.

12 Changes to Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or by posting a prominent notice in the platform at least 14 days before the new terms take effect. Your continued use of TotalApp after that date constitutes your acceptance of the updated terms.
